You (“You” or “User” or “I”) are being provided access to the MyCare information system.¬† To access MyCare, You must agree to be bound by this Terms and Conditions of Use of MyCare (“Agreement”) and indicate Your agreement by clicking the “I agree” button on the bottom of this Agreement.
YOUR INITIAL REGISTRATION AND CONTINUED ACCESS TO MYCARE CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS OF USE INCLUDING ALL AMENDMENTS AS MAY BE MADE FROM TIME TO TIME.¬† YOU MAY ACCESS THE VERSION OF THIS AGREEMENT THEN IN EFFECT BY GOING TO THE MYCARE WEBSITE AT https://mycare.yumaregional.org/.
What is MyCare Medical Records Access? Yuma Regional Medical Center (“YRMC”) maintains an electronic health record for YRMC patients and for patients of community providers who participate in the YRMC electronic medical record system.¬† MyCare is an Internet application that allows a patient to have secure web-based access to portions of their MyCare electronic health record. MyCare access is an additional service provided to patients. MyCare provides no guarantees that access will continue indefinitely or in perpetuity. The information displayed in MyCare may not be the User’s complete health record. In the event that MyCare access is deactivated or you would like a copy of your complete health record you may request their health records through the YRMC Health Records department or participating health care providers. Your MyCare record may therefore include your medical record information from your inpatient and outpatient visits at YRMC and any information that may be input by your health care provider for care provided outside of YRMC.¬†
How can I use MyCare to Communicate with my Health Care Providers?¬† MyCare provides a secure, convenient communications avenue for non-emergency messages to your health care providers such as prescription renewals and lab results. You may also be able to send secure messages through MyCare to your health care provider.¬† YRMC and your health care provider are committed to using their best efforts to provide timely responses to electronic inquiries.¬† However, in some cases, the clinic staff that needs to respond to an electronic inquiry or other communication may not be immediately available.¬† You should allow three (3) business days for a response. Accordingly, do not use MyCare to communicate emergency situations requiring immediate attention to your provider(s).¬† Also, remember that your provider is only able to respond to electronic messages with accurate and complete information.¬† If Your message does not provide sufficient information, YRMC or your provider will be unable to provide accurate and reliable services.
Should I use MyCare In An Emergency?¬† NO.¬† MYCARE SHOULD NEVER BE USED TO COMMUNICATE EMERGENCY SITUATIONS REQUIRING IMMEDIATE ATTENTION.¬† The medical or health care information provided on MyCare is not a replacement for proper medical attention. Therefore, the MyCare messaging service should not be used for urgent messages for YRMC and/or your health care provider. If you believe you are suffering from an urgent medical issue, contact YRMC or your physician by telephone and/or 911 services immediately, and/or go to the Emergency Department of a local hospital.
How do I Request MyCare Account?¬† You may register for your MyCare account online at https://mycare.yumaregional.org/.¬† All requests for an account must be made to your health care provider.
Can Minors Access MyCare? An individual must be age 18 or older to request a personal account. Minor children between the ages of 12 and 17 (inclusive) will have limited access to participate in MyCare services with consent from a parent or guardian.¬† An individual recognized as a parent regardless of age may establish a MyCare Account for their minor children.
Can a Minor’s Parent or Guardian Use MyCare to Access the Minor’s Information?¬† Parents or guardians of unemancipated minor children may request access to the minor child's account as outlined in the following section of this Agreement.¬† However, under State and Federal law, there are certain types of medical information that the parent or guardian of a minor patient may not view without consent of the minor patient.¬† Because of these requirements, YRMC will offer limited MyCare service to parents and guardians of minors.¬† When a minor patient reaches age 18, proxy access will be revoked.
How Can a “Proxy”‚ÄĒsuch as a Parent, Guardian, Agent under a Health Care Power of Attorney, Surrogate or other Authorized Individual‚ÄĒRequest Access to a Patient’s Information Through MyCare?¬† A parent or guardian of an unemancipated minor child or any individual over 18 may request access to another individual’s MyCare account by completing the appropriate “Proxy Access” forms and submitting them to YRMC and/or your healthcare provider. ¬†Proxy access to MyCare will be granted only to individuals who can demonstrate the legal right to the account holder’s medical information. ¬†Only one person will be granted proxy access to an individual’s account. ¬†A MyCare account will be activated for both the proxy and the account holder. ¬†If the proxy’s legal relationship with the account holder changes, the proxy must inform YRMC immediately by calling YRMC Health Records at (928) 336-7345 or by sending written notice to YRMC at the following address: Attention: YRMC Health Information Management Department/MyChart Proxy 2400 S Avenue A Yuma, Az 85364, YRMC and/or your health care provider reserve the right to revoke proxy access at any time for any reason.
How do I know that MyCare is Secure and my Information is Kept Confidential?¬† YRMC and your health care providers are committed to protecting the confidentiality of your medical information in accordance with federal and state law.¬† Accordingly, YRMC has taken steps to secure your electronic health record information and the information sent to, and received through, MyCare against unauthorized access and use.¬† Firewalls, passwords, encryption, and audit trails are used to safeguard patients’ electronic health information.¬† In addition, YRMC limits employee access to your health records and employee ability to enter or view information as required by federal and state privacy laws.
You can tell when you are secure by looking at the location (URL) field on your Web browser. ¬†If the URL begins with https:// (instead of http://), the document comes from a secure server. ¬†This means your data cannot be read or deciphered by unauthorized individuals. ¬†You verify that your connection to YRMC and/or your health care provider is secure by validating the digital certificate. ¬†If you are using a browser other than Internet Explorer please refer to that web browser’s documentation for more information on how it handles digital certificates.
In addition, all MyCare account holders must choose a login ID and Password to provide two layers of authentication.¬† These are stored in an encrypted database that is isolated from the Internet.
Your Role in Safeguarding Your Own Privacy.¬† As a MyCare user, You also have a role in maintaining the security of Your electronic health information.¬† Your role includes: 1) changing your Password on a regular basis; and 2) keeping your Login ID and Password confidential.¬† You must also safeguard the privacy of Your e-mail.¬† Patients who are users of MyCare will be notified via e-mail when there are new results or new messages to be viewed on MyCare. ¬†This means that any person with access to a patient’s e-mail will be able to see this notification. ¬†This could include the patient’s spouse, employer or anyone else that can access a patient’s e-mail account.¬† Although no private medical information will be included in the email notification, the notification that new results or new messages are available by accessing MyCare may be information that a patient would not want others to know. ¬†Thus, patients should take this into account when providing an e-mail address or designating a Proxy.
E-mail Privacy ‚Äď Patients who are users of MyCare should be aware that they will be notified via e-mail when there are new results or new messages to be viewed on MyCare. This means that any person with access to a patient’s e-mail will be able to see this notification. This could include the patient’s spouse, employer or anyone else that can access a patient’s e-mail account. Although no private medical information will be sent, the notification that new results or new messages are available by accessing MyCare may be information that a patient would not want others to know. Thus, patients should take this into account when providing an e-mail address or designating a proxy.
Inappropriate Use of MyCare.¬† Access to MyCare is granted to users for the purpose of furthering their medical care by allowing them access to their health record information and facilitating communication with their health care providers.¬† Use of MyCare unrelated to these purposes may result in the suspension or termination of access privileges. Other improper activities that may result in termination of MyCare access include, but are not limited to, the use of inappropriate, threatening, harmful, abusive, defamatory, vulgar, obscene or abusive language, improper sharing of User’s Login ID or Password, reserving appointment times that are not needed or are frequently cancelled and other activities that are deemed, at the sole discretion of YRMC and/or your health care provider, to cause a disruption of YRMC or your health care provider’s operations. YRMC and/or your health care provider reserve the right to revoke User access at any time for any reason.¬† Please see the When Will My Account Be Deactivated? section below for more details.
When Will My Account Be Deactivated?¬† YRMC reserves the right to suspend or deactivate access to MyCare for any reason in its sole and absolute discretion. ¬†Specifically, your MyCare account may be suspended or deactivated by YRMC for the following list of reasons. ¬†The list does not include every possible reason to deactivate an account and each circumstance will be evaluated individually.¬†
How Do I Obtain a Medical Record if My Account is Deactivated or Suspended?¬† In the event that MyCare access is deactivated, you may request health records directly from the YRMC Health Records Department or Your health care provider, as appropriate.
User’s Acknowledgement of Terms and Conditions of Use and Agreement
By clicking the “I Agree” button at the bottom of this Agreement, I affirm that I am requesting access to portions of my (or, in the case of Proxy access, another individual’s) health information and the ability to communicate with YRMC and/or health care providers concerning health information via the Internet using an electronic application called MyCare.
I understand and agree that MyCare should never be used for urgent matters. Therefore, for all urgent matters that I believe may immediately affect my health or well-being, I will, without delay, contact YRMC or my health care provider by telephone or 911 services immediately, and/or go to the Emergency Department of a local hospital.
I understand that it is extremely important that I keep the Login ID and Password that I use to access MyCare completely confidential. ¬†If at any time I believe that the confidentiality of my password has been compromised I will change it by logging in to MyCare, going to My Account, and choosing Change Password. ¬†I understand that YRMC and/or my health care providers are not responsible for and disclaim any and all liability or consequential damages arising from a breach of confidentiality resulting from my sharing my password, losing my password, or the theft of my password.¬† I shall also immediately notify the YRMC Compliance Officer at (928) 336-7600 or Information Technology Division Security Officer at (928) 336-7991, if unable to reach either party call the Information Technology Division Help Desk at (928) 336-7290, if I suspect my password may be used by an unauthorized individual, has been lost, or stolen.
I understand that YRMC and/or my health care provider give no guarantees that access to MyCare will continue indefinitely or in perpetuity.¬† In the event that MyCare access is deactivated, I may access my YRMC health records through the YRMC Health Information Management Department and my provider records directly from my health care provider.
During times when MyCare is unavailable, or in emergency situations, other communications, such as telephone, should be used to contact YRMC and/or my physician.
I understand that MyCare is not a diagnostic tool. ¬†MyCare is not a substitute for direct interaction with my physician/provider.¬† If I need medical assistance or have a question for my provider, I will contact my provider.
YRMC DOES NOT GUARANTEE THAT MYCARE WILL PERFORM ERROR FREE OR UNINTERRUPTED.¬† I understand that MyCare may not be available to me all of the time due to system failures, back-up procedures, maintenance, or other causes beyond the control of YRMC and/or my health care provider. ¬†Access is provided on an “As-Is, As-Available” basis and YRMC and/or my health care provider do not guarantee that I will be able to access MyCare at any particular time.¬† YRMC EXPRESSLY DISCLAIMS ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OR MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.¬†
IF YOUR HEALTH CARE PROVIDER OFFERS YOU THE OPPORUTNITY TO USE MYCARE IT IS BECAUSE YRMC HAS ENTERED INTO A SUBLICENSE AGREEMENT WITH YOUR PROVIDER TO HOST YOUR ELECTORNIC MEDICAL RECORD.¬† YRMC IS NOT RESPONSIBLE FOR, AND DISCLAIMS ANY AND ALL LIABILITY FOR, THE ACCURACY AND COMPLETENESS OF DATA INPUT INTO YOUR ELECTRONIC MEDICAL RECORD BY YOUR PROVIDER.¬† YOU ALSO ACKNOWLEDGE THAT YRMC IS NOT RESPONSIBLE FOR THE ACCURACY, COMPLETENESS OR TIMELINESS OF COMMUNICATIONS (OR THEIR CONTENT) MADE BY OR BETWEEN YOU AND YOUR PROVIDER USING MYCARE.
I ALSO UNDERSTAND THAT YRMC AND/OR MY HEALTH CARE PROVIDER TAKE NO RESPONSIBILITY FOR AND DISCLAIM ANY AND ALL LIABILITY ARISING FROM ANY INACCURACIES OR DEFECTS IN SOFTWARE, COMMUNICATION LINES, VIRTUAL PRIVATE NETWORKS, THE INTERNET OR MY OWN INTERNET SERVICE PROVIDER (ISP), ACCESS SYSTEM, COMPUTER HARDWARE OR SOFTWARE, OR ANY OTHER SERVICE OR DEVICE THAT I USE TO ACCESS MYCARE.¬†¬†
UNDER NO CIRCUMSTANCES SHALL YRMC, ITS PARENT OR AFFILIATED ENTITIES, OR THEIR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR INSURERS BE LIABLE TO USER FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY NATURE OR KIND WHATSOEVER OR FOR ANY EXEMPLARY OR PUNITIVE DAMAGES, AND NOTWITHSTANDING THE FORM (E.G., CONTRACT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) IN WHICH ANY LEGAL OR EQUITABLE ACTION MAY BE BROUGHT AGAINST YRMC AND WHICH ARISES OUT OF THIS AGREEMENT, USER’S REGISTRATION OR USE OF MYCARE, REGISTRATION OR USE BY A PROXY, OR THE SUSPENSION OR DEACTIVATION OF USER’S OR PROXY’S MYCARE ACCOUNT.
This Agreement constitutes the entire Agreement between User, YRMC and/or your healthcare provider concerning the subject matter of this Agreement and supersedes any and all oral or written understanding or agreements.¬† User may not modify or amend this Agreement without YRMC’s and/or healthcare provider’s written consent.¬†
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Arizona and all disputes arising hereunder must be adjudicated in the State or Federal courts located in Yuma County, Arizona.
